Privacy policy

These Terms and Conditions govern the entire legal relationship between Lou Anastasia Lefebvre, domiciled at 11 chemin Emile Bressler, 1226 Thônex, Switzerland, a sole trader (hereinafter, “All Champs”) and any person booking or participating in a Service offered by All Champs or purchasing a Product from the All Champs online store (hereinafter, the “Customer”). When booking an Event, these Terms and Conditions and the booking confirmation sent to the Customer by e-mail specifying the dates, location, price and all services included in the Event (hereinafter, the “Booking Confirmation”) form an integral part of the contract concluded with All Champs.

In the event of the purchase of a Product in the All Champs online store, these GTC form an integral part of the sales contract concluded with All Champs.

All users of the All Champs website (https://www.allchamps-services.com/) are subject to these GTC and in particular to Appendix 1 (Personal data protection declaration).

2- ALL CHAMPS SERVICES AND PRODUCTS

 

All Champs offers a wide range of services in the field of sport and well-being, including individual or group training sessions (face-to-face or by videoconference) and the organization of holidays or various events in Switzerland or abroad (hereinafter, the “Service(s)”).

All Champs reserves the right to have a Service performed by any person of its choice.

All Champs also offers the possibility of purchasing various products and, in particular, t-shirts, bags, decorative objects or e-books in its online store or in its Studio (hereinafter, the “Product(s)”).

3- PRIVATE and SEMI-PRIVATE ALL-CHAMPS COURSES (COACHING)

3.1 SERVICES INCLUDED

 

Private and semi-private courses offered by All Champs are held at the All Champs studio located rue des Pierres-du-Niton, 1207 Geneva (HERSTREET) (hereinafter, the “Studio”) or at any other location indicated in advance by All Champs, in the presence of the Customer(s).

As part of a private lesson, All Champs provides personalized coaching in the presence of a single Customer (hereinafter, “Private Coaching”). As part of a semi-private course, All Champs provides personalized coaching to several Customers.

simultaneously and in the presence of a maximum of 3 Customers (hereinafter, “Semi-Private Coaching”).

The duration of a Private or Semi-Private Coaching is at least 50 minutes.

 

3.2 TERMS OF PAYMENT

 

Each credit purchased gives the right to a Coaching carried out by All Champs, either private (hereafter, the “ Private Coaching Credit(s) All Champs ‘), or semi-private (hereafter, the ’ Semi- Private Coaching Credit(s) All Champs ”).

The Customer pays the full price of the All Champs Coaching Credit(s) at the time of purchase on the All Champs website. Payment is made in the currency selected by the Customer, in Swiss francs (CHF) or in Euro (EUR).

 

3.3 TERMS OF USE OF CREDITS

 

By purchasing one or more All Champs Coaching Credit(s), the Customer accepts the following terms of use:

(i) Purchase of individual Coaching All Champs Credits: each Coaching All Champs Credit must be used within one month of the date of purchase;

(ii) Purchase of a pack of 5 Coaching All Champs Credits: the Coaching All Champs Credits must be used within 4 months of the date of purchase;

 

(iii) Purchase of a pack of 10 Coaching All Champs Credits: Coaching All Champs Credits must be used within 6 months of purchase.

Upon presentation of a medical certificate attesting that the practice of sports is contraindicated for a certain period of time, the above-mentioned deadlines may be extended by the same amount of time. It is the customer's responsibility to inform All Champs before the expiry of the period of use.

The Customer is not entitled to any refund of the All Champs Coaching Credit(s) purchased.

The Customer may not use the All Champs Coaching Credit(s) in connection with other Services provided by All Champs, such as group classes, events or stays, or to make purchases of Products in the All Champs boutique.

3.4 RESERVATION PROCESS

 

All Champs Private Coaching Credits allow you to book Private Coaching sessions only.

All Champs Semi-Private Coaching Credits are used to book Semi-Private Coaching sessions only. The customer who has booked a Semi-Private Coaching session with his/her All Champs Semi-Private Coaching Credit is responsible for bringing together the other customers with whom he/she wishes to have the session.

Using the Coaching Privé or Semi-privé All Champs Credit(s) purchased, the Customer may book a Coaching Privé or Semi-privé session on the schedule proposed by All Champs, within the limit of the number of sessions available.

Reservations are made on the platform provided or, failing that, by contacting All Champs by e- mail (info@allchampsbylou.com) or by telephone (+41(0)78.695.81.74).

 

3.5 BOOKING CANCELLATION PROCEDURE AND CHARGES

 

 

The customer may cancel any reservation for a Private or Semi-private Coaching directly on the platform provided or, failing that, by contacting All Champs by e-mail (info@allchampsbylou.com) or by telephone (+41(0)78.695.81.74).

 

Cancellation of a Private or Semi-private Coaching session incurs the following charges for the Customer:

(i) Up to 24 hours before the Coaching: no charge; the All Champs Private or Semi-Private Coaching Credit can be used again to book another Coaching. Please note that cancellation of a Semi-private Coaching Credit must be made by the customer who originally booked the Coaching, and applies to all participating customers;

(ii) In the 24 hours preceding the Coaching: 100% of the total price of the All Champs Coaching Credit; the All Champs Coaching Credit is considered definitively used and cannot be used again to book another Coaching.

In the event that only some of the Customers cancel the Semi-private Coaching session, the session may be maintained if the remaining Customer(s) so wish. In this case, it will not be possible to request a refund of the All Champs Semi-Private Coaching Credit on a pro rata basis, and a full All Champs Semi-Private Coaching Credit will be considered definitively used.

 

4- ALL CHAMPS GROUP CLASSES

4.1 SERVICES INCLUDED

 

Group classes offered by All Champs are held in the presence of customers at the location indicated in the course description.

The duration of a group class is at least 45 minutes. The exact duration of each group lesson is specified in the lesson description.

The services included in the Service vary according to (a) the type of group lesson booked and (b) the location of the group lesson. The Customer may consult the special conditions applicable to each type of group lesson on the All Champs website.

4.2 PAYMENT TERMS

Each credit purchased gives the right to participate in a group lesson offered by All Champs (hereinafter, the “All Champs Credit(s)”).

 

The Customer pays the full price of the All Champs Credit(s) at the time of purchase on the All Champs website. Payment is made in the currency selected by the Customer, in Swiss francs (CHF) or in Euro (EUR).

4.3 TERMS OF USE OF CREDITS

 

By purchasing one or more All Champs Credit(s), the Customer accepts the following terms of use:

(i) Purchase of individual All Champs Credits: each All Champs Credit must be used within one month of the date of purchase;

(ii) Purchase of a pack of 5 All Champs Credits: All Champs Credits must be used within 4 months of purchase;

(iii) Purchase of a pack of 10 All Champs Credits: All Champs Credits must be used within 6 months of purchase.

4.4 RESERVATION PROCESS

Using the All Champs Credit(s) purchased, the Customer may reserve the group lesson of his/her choice, from the range offered by All Champs, subject to the number of places available.

Reservations are made on the platform provided or, failing that, by contacting All Champs by e- mail (info@allchampsbylou.com) or by telephone (+41(0)78.695.81.74).

4.5 RESERVATION CANCELLATION PROCEDURE AND CHARGES

 

The customer may cancel any booking for a group lesson directly on the platform provided or, failing that, by contacting All Champs by e-mail (info@allchampsbylou.com) or by telephone (+41(0)78.695.81.74).

Cancellation of a group lesson will incur the following costs for the customer:

(i) Up to 24 hours before the group lesson: no charge; the All Champs Credit can be used again to book another group lesson;

(ii) Within 24 hours before the group lesson: 100% of the total price of the All Champs Credit; the All Champs Credit is considered definitively used and cannot be used again to book another group lesson.

5- ALL FIELDS STAYS

 

5.1 INCLUDED AND NON-INCLUDED SERVICES

When the Customer books a stay with All Champs, accommodation and group classes (PyroFlow, yoga, circuit training or any other type of training) are included in the Service.

Depending on the location and type of stay booked, other services may be added to these general services, as specified in the Reservation Confirmation.

However, all costs related to the stay booked, in particular means of transport to the place of stay (such as plane tickets, train tickets, car journeys), travel insurance and any services not mentioned in the Booking Confirmation are not included. It is therefore the Customer's responsibility to book his or her trip personally, to obtain any documents required by the authorities of the destination country (such as identity papers, visas, or any other necessary documents) and to take out any insurance (such as accident, repatriation or cancellation insurance) useful or necessary for the stay.

 

5.2 BOOKING PROCESS AND PAYMENT TERMS

 

5.2.1 In order to book a holiday with All Champs, the Customer makes an online reservation, subject to availability, on the All Champs website.

5.2.2 Once the online reservation has been made, the following payment terms apply:

1. Within 24 hours, the Customer pays (i) 50% of the total price of the selected stay, or (ii) 100% of the total price of the selected stay when the reservation is made within 60 days of the scheduled start date of the stay (hereinafter referred to as the “Reservation Amount”), by bank transfer to the following bank account:

All Champs reserves the right to put back on sale any place that has been booked online if the Customer does not pay the Reservation Amount within the allotted time.

The reservation is only considered definitive once the Reservation Amount has been credited to the above-mentioned bank account. A Reservation Confirmation is then sent to the Customer.

2. No later than 60 days before the scheduled start date of the holiday, the balance of the price of the holiday selected must be paid by the Customer into the bank account mentioned above.

5.2.3 For certain holidays, All Champs may provide special payment terms, as indicated on its website and in the Reservation Confirmation.

5.2.4 The cancellation conditions mentioned in section 5.3 below apply even if the full price of the holiday has not yet been paid.

 

5.3 CANCELLATION

 

The Customer may cancel the reserved stay by sending written notification to the following e-mail address: info@allchampsbylou.com. The cancellation will only be effective upon receipt (a) by All Champs of the Customer's written notification and (b) by the Customer of a confirmation of receipt sent by All Champs.

Any effective cancellation of a stay will incur the following charges for the Customer:

(i) 60 days or more before the scheduled start of the stay: 30% of the total price of the stay;

(ii) Between 30 and 59 days before the scheduled start of the holiday: 50% of the total cost of the holiday;

(iii) Less than 30 days before the scheduled start of your stay: 100% of the total price of your stay.

All Champs will not reimburse the customer if the cancellation occurs after the start of the holiday or if the customer cannot or does not wish to take part in any of the services included during the holiday.

It is the customer's responsibility to take out appropriate travel insurance, covering cancellation costs and repatriation costs in the event of accident or illness.

5.4 COMPLAINTS

 

The Customer must inform All Champs of any problem that may arise during his stay, either immediately to the person in charge on site, or by e-mail, within a maximum of 10 days following the return date of the stay, to the following e-mail address: info@allchampsbylou.com.

 

All Champs undertakes to use its best endeavours to find an appropriate solution to the complaint. The Customer undertakes to take all steps to reduce the damage and, in particular, to inform All Champs immediately of any problem encountered.

6- EVENTS

6.1 SERVICES INCLUDED

 

All Champs organizes events from time to time and the services offered vary for each event. The services included are specified on the All Champs website and in the Reservation Confirmation.

6.2 RESERVATION PROCESS

 

In order to reserve an All Champs event, the customer makes an online reservation, subject to availability, on the All Champs website.

The customer pays the full price of the All Champs event at the time of booking on the All Champs website. Payment is made in the currency selected by the customer, in Swiss francs (CHF) or in Euro (EUR).

6.3 TERMS AND CHARGES FOR CANCELLING A RESERVATION

 

The Customer may cancel any reservation for an event directly on the online platform provided or, failing this, by contacting All Champs by e-mail (info@allchampsbylou.com) or by telephone (+41(0)78.695.81.74).

Cancellation of participation in an event will incur the following costs for the Customer:

(i) Up to 5 days before the scheduled date of the event: no charge; All Champs refunds the full price paid by the Customer; and

(ii) Within 5 days prior to the scheduled date of the event: 100% of the total price paid by the Customer; All Champs will not refund.

When the Customer is entitled to a refund of the price paid, All Champs undertakes to make the payment within 7 working days from the date on which All Champs is in possession of all the information enabling it to proceed with the payment.

 

7- BOUTIQUE ALL CHAMPS

7.1 CONCLUSION OF CONTRACT

All Champs offers for sale various Products in its Studio or on the online store, within the limits of available stocks.

The contract is concluded with All Champs as soon as the Customer makes a purchase in the Studio or places an order in the online store.

When the order is placed online, receipt of the order is confirmed to the Customer by e-mail by means of an order confirmation.

7.2 PRICE AND PAYMENT TERMS

 

The price of the Products is indicated in Swiss francs (CHF) or in Euro (EUR) and includes all taxes to be levied, with the exception of delivery charges where applicable.

When the purchase is made at the Studio, the Customer pays the full price of the Product(s) purchased in cash or by QR code.

When the order is placed online, the Customer pays the full price of the Product(s) selected, as well as the delivery charges, at the time of ordering on the All Champs website. Payment is made in the currency selected by the Customer, in Swiss francs (CHF) or in Euro (EUR).

 

7.3 TERMS OF DELIVERY

 

All Champs delivers the Products offered in the online store only within Switzerland, at the at the Customer's expense and risk.

The delivery times mentioned at the time of the order are given as an indication, without any without any commitment on the part of All Champs.

7.4 RIGHT OF RETURN

 

Any Product purchased from the Studio or ordered from the online store and delivered to the Customer may be returned to All Champs, subject to compliance with the conditions set out in this Section, if it has the following characteristics:

- The Product has not been used;

- The Product has not been damaged; and

- The Product is returned in its original packaging, with all accessories. accessories.

Excluded from this right of return are foodstuffs and E-books (see Section 7.5).

The right of return, at the Customer's expense and risk, may only be exercised within 14 days of purchase or receipt of the Product by the Customer. When the order is placed online, the Customer must notify All Champs of his/her wish to return the Product by e-mail and undertakes to return the Product in suitable packaging.

Insofar as the Product can be returned and after verifying that the Product meets the requirements set out in §1 and §2 of this Section, All Champs undertakes to reimburse the Customer the amount of the Product price (with the exception of the initial delivery and return costs) within 14 days of receipt of the returned Product. If the Product does not meet the requirements set out in §1 and §2 of this Section, All Champs will not proceed with any refund and will inform the Customer accordingly.

7.5 E-BOOK

 

The content of each e-book, which is in electronic format, varies according to the topic covered. E-books may contain a video, an audio podcast, a recipe and/or any other element related to the theme.

Once the order has been placed on the All Champs website, the link enabling the purchased e- book to be downloaded (hereinafter, the “E-book Link”) is sent by e- mail to the Customer within 24 hours.

The Customer is not authorized to pass on the E-Book Link or the e-book itself to a third party or to trade in it.

Once the E-book Link has been sent by All Champs, the Customer may neither cancel the order nor request a refund of the price of the e-book purchased.

8- LIABILITY

8.1 EXCLUSION OF LIABILITY All Champs shall not be held liable:

 

(i) For improper performance or non-performance of one or more of its obligations, in connection with the provision of a Service or the sale of a Product, except in case of fraud or gross negligence;

(ii) In the event of damage to or loss of the Product during delivery and from receipt of the Product by the Customer;

(iii) In the event of damage caused directly or indirectly by the use of a Product;

(iv) For the acts of an auxiliary which causes damage to the Customer, even in the case of fraud or gross negligence; it is up to the Customer to engage the responsibility of this auxiliary directly;

(v) For the acts of a third party (in particular the non-performance by the transport company of its obligation to the Customer), of another Customer, of the Customer himself or of the use of his personal equipment or whose cause stems from a physical predisposition or a medical incompatibility of the Customer; the Customer accepts to bear the risks inherent in the practice of

 

the sporting activities proposed by All Champs and must personally make sure with a doctor that he is fit for such a practice:

(vi) In the event of loss or damage of any kind directly or indirectly related to the use of its website; All Champs does not guarantee the proper functioning of its website or any computer equipment belonging to the Customer and does not incur any liability in the event of a computer bug.

8.2 LIMITATION OF LIABILITY

Within the framework of a stay booked with All Champs, All Champs engages its contractual responsibility which is however limited in its amount to the double of the total price paid by the Customer for the stay concerned (with the exception of fraud or serious fault).

9- FORCE MAJEURE

In the event of unforeseeable circumstances not attributable to All Champs (such as war, riot, civil unrest, strike, terrorist activity, natural or nuclear disaster, epidemic or pandemic, fire, severe weather conditions or any other circumstance falling under force majeure) preventing the partial or total performance by All Champs of its obligations permanently or for an indefinite period, All Champs will be released from its obligations to the Customer. All Champs undertakes to inform the Customer as soon as possible.

In such circumstances, All Champs will not reimburse any amounts already paid by the Customer, nor compensate the Customer for any damage suffered, to the extent of its enrichment and subject to mandatory legal provisions. The Customer shall pay the amounts still due to All Champs, within the same limits.

10- COVID-19

If, as a result of the COVID-19 pandemic, the performance of a Service is temporarily or permanently prevented, the consequences provided for in the event of an event of force majeure (cf. Section 9) will apply ipso jure.

 

11- DATA PROTECTION AND PRIVACY

The Data Protection Declaration (APPENDIX 1 - PERSONAL DATA PROTECTION DECLARATION) applies to the processing of personal data by All Champs.

12- MODIFICATION OF THE TERMS OF USE

All Champs reserves the right to modify these GTC at any time. The customer will be informed of any such changes as soon as possible.

13- APPLICABLE LAW AND PLACE OF JURISDICTION

These GTC and the Reservation Confirmation are governed exclusively by Swiss law. Any legal action must be brought before the competent courts of the Canton of Geneva, subject to mandatory legal provisions.

 

APPENDIX 1 - PRIVACY STATEMENT

This Privacy Statement is an integral part of the All Champs GTC.

1- What is “personal data”?

The term “personal data” refers to any information relating to an identified or identifiable person, such as name, address, telephone number, photo or IP address.

2- To which legal provision(s) is All Champs subject with regard to data processing?

 

All Champs is subject to Swiss data protection law (including in particular the Federal Data Protection Act (DPA)) as well as European Union data protection law (including in particular the General Data Protection Regulation (GDPR)).

 

3- What personal data is collected and for what purpose?

 

All Champs collects various personal data, in particular when you create a personal account on the All Champs website, contact All Champs, book a Service, purchase All Champs Credits or buy a Product in the All Champs online store.

Personal data collected by All Champs includes first name, last name, home address, e-mail address, telephone number, user name and password, information concerning newsletter subscriptions, IP address, information concerning contracts concluded with All Champs, photos and videos produced as part of a Service.

All Champs collects this personal data for the following purposes:

- Creation and management of a personal account on the All Champs website;

- Conclusion and execution of a contract;

- Communication with the Customer as part of the performance of a Service, a sales contract or for sales contract or for marketing purposes;

- Marketing communications on social networks or any other media;

- Compliance with All Champs' legal obligations, in particular accounting or tax obligations.

All Champs retains this personal data for as long as it is useful for the purpose for which it was collected and, in any case, within the limits provided by law.

 

4- What personal data is passed on to third parties and for what purpose?

 

In principle, All Champs only uses the personal data collected in the context of its sole proprietorship.

Nevertheless, All Champs may sometimes communicate personal data collected to third parties for the purpose of performing a Service. Indeed, All Champs may communicate personal data to coaches in charge of the execution of an All Champs group class or to external service providers in the context of the execution of a Service (for example, with a view to booking accommodation or a venue for the execution of an event).

In some cases, personal data may be communicated to third parties located abroad, in particular when the Service is to be performed there. All Champs will only communicate personal data concerning the Customer that is strictly necessary for the execution of the contract.

5- What rights do customers and users have?

 

The Customer or any user of the All Champs site may at any time request access to the personal data collected, have them corrected or completed, object to their processing or demand their deletion.

The Customer or any user of the All Champs site may assert these rights by sending written notification to the following e-mail address: info@allchampsbylou.com. All Champs may then use the contact e-mail address to communicate with the customer or user for this sole purpose.

 

6- What security measures are applied to protect personal data?

 

All Champs has implemented all appropriate technical and organizational measures to guarantee the confidentiality and integrity of personal data processed.

However, the transmission of information by the customer or the user of the All Champs website via the Internet or any other electronic medium entails certain security risks. All Champs cannot guarantee the security of information transmitted via this medium.
